2. AI BUSINESS SOLUTIONS

XpandTEK, LLC provides a suite of AI-powered business tools designed to automate communication, marketing, and customer engagement (collectively, the “AI Business Solutions”). These include, but are not limited to:

AI Employee

Each Service offers distinct functionality, such as automated posting, call and text management, conversational messaging, and AI-assisted reception. Access to these Services may require a paid subscription following any applicable trial or demo period. Pricing, features, and availability are listed on XpandTEK’s official websites or promotional materials and may be modified at the Company’s discretion.

3. FREE TRIAL

XpandTEK, LLC may offer a limited-time free trial to eligible users.

AI Social Media Planner - Trial Period

The Company may provide new users with limited access to the AI Social Media Planner – Self Serve Plan (the “Service”) free of charge for a period of thirty (30) days. No payment information is required to initiate the trial period. Upon expiration of the thirty (30) day trial, continued access to the Service will require the User to select and activate a paid subscription plan. Users will be notified with instructions on how to activate a paid plan prior to the expiration of the trial period. The trial access applies exclusively to the Self Serve Plan and does not include any managed or done-for-you services.

4. PROJECT BASED SERVICES

Web Design Services

XpandTEK, LLC may offer custom web design services on a project or subscription basis (the “Service”). Pricing, timelines, and deliverables for each project will be specified in a written proposal or agreement accepted by the User prior to the start of work. A setup or design fee may be required before work begins. All payments for web design services are non-refundable once work has commenced, as such services are customized to the User’s specifications. The Company reserves the right to adjust project timelines if delays occur due to the User’s failure to provide requested materials, approvals, or information in a timely manner.

Web Speed Optimization Services

XpandTEK, LLC may provide web speed optimization services, including diagnostics, performance audits, and optimization of existing websites (the “Service”). These services are offered as a one-time project, unless otherwise stated in writing. Payment is required in full prior to the start of optimization work. Because optimization efforts are technical and customized to each website, all payments are non-refundable once work has commenced. The Company makes commercially reasonable efforts to improve website performance but does not guarantee specific PageSpeed scores, search rankings, or outcomes.

5. Acceptable Use:

You agree to use the system only for legitimate business purposes. Use of the service for spam, harassment, or illegal purposes is strictly prohibited.

6. Data Handling:

Any data collected through the Services or during a trial or demo period will be stored securely and handled in accordance with our Privacy Policy. Users may request deletion of their data by contacting [email protected].

7. No Guarantees:

While XpandTEK provides tools designed to improve communication, automation, and performance, the Company makes no guarantees of specific results, leads, revenue, or performance outcomes.

8. Limitation of Liability:

XpandTEK, LLC shall not be liable for any missed opportunities, lost income, data loss, or other damages arising from delayed, failed, or missed messages, system errors, service interruptions, or any other technical or operational issues that may occur in connection with the use of its Services, whether during a trial, demo, or paid subscription period.

9. Indemnification

You agree to defend, indemnify, and hold harmless XpandTEK and its affiliates from and against any claims, liabilities, damages, and expenses arising out of your use of the Services or violation of these Terms.

10. Third-Party Services and Integrations

Our Services may integrate with or link to third-party services (e.g., Facebook, Google). We are not responsible for the content, terms, or privacy practices of third-party services.

Use of these third-party integrations is at your own risk and subject to their respective terms.

11. Termination

You may cancel your account at any time by contacting [email protected]. XpandTEK may suspend or terminate your access to the Services if:

- The User violates these Terms

- Payment is overdue,or

- Suspension is required by law or necessary for security reasons

Upon termination, your right to use the Services will cease immediately.

12. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. XpandTEK does not guarantee that the Services will be error-free, secure, or uninterrupted.

13. Changes to Terms

XpandTEK, LLC may modify these Terms at any time. If material changes occur, notice will be provided via email and/or posting of the updated Terms on our website. Continued use of the Services constitutes acceptance of any revisions.

14. Limitation of Liability

To the maximum extent permitted by law, XpandTEK shall not be liable for:

- Any indirect, incidental, special, consequential, or punitive damages,

- Any loss of data, revenue, or profits arising from your use of the Services.

XpandTEK’s total liability for any claim related to the Services shall not exceed the amount paid by you for the Services in the six months prior to the event.
